1) Introduction by Cllr Doe:
1. Who’s here and role – Scott as facilitator, not as legal or planning expert, but as Head of the Cuncil’s Leisure Services. Cllrs Cunningham, Councillor Frank Thompson, Mr. Satinder Sehra
Background to “why here”?
2. Intention of the Council is to build a new pavilion which at least replaces the one that had to be destroyed as being unsafe for use.
3. The Council cannot afford to build it itself though it has continued to reserve £60k for approaching three years; an unusual commitment but it has all-party support.
4. Scott Herbertson sought sponsors from a wide range of potential fund- holders but to no avail, except for the offer from Mr. Sehra. Some funds are simply not available to Councils.
5. Mr. Sehra’s proposals received Planning Permission, subject to what is known as a section 106 agreement. Whereas the Planning Permission, which was agreed by the Council’s Development & Control Committee unanimously, sets out the intent, that intent needs to be tied down with a series of detailed agreements between Mr. Sehra and the Council. Normally such agreements are delegated to officers. But in this case, because of the various concerns, Cllr Cunningham, who sits on that Committee, got agreement that the final s106 would not be signed off before it had been reviewed by the Chairman, Councillor Harris and the Party Spokesmen.(cllr Cunningham)
6. Four important elements of the s106:
a. The Highways details. These are virtually finalised and take account of issues already raised by you and others, for example, the Governors of Latchmere School.
b. The Community use details. These will be defined as they are for the use of this pavilion.
c. The financing details. The leaseholder will be Latchmere Community Pavilion Limited. This company will be limited by guarantee. (This Dinton Field Pavilion, of which I am a Director, is also limited by guarantee). The Council has checked these items out!
d. The Management Plan. I understand M. Sehra has a draft of that here? That sets out the agreed proportions of use and users, in order not least to protect the Community Use.
7. When all those elements have been agreed the Council will prepare a lease agreement.
